These Terms of Use ("Terms") govern your access to and use of thesylasproject.org (the "Site") and the programs offered by The Sylas Project, Inc. ("The Sylas Project," "we," "us," or "our"), including our Survival Swim Scholarship and donations. By using the Site, applying for a scholarship, or making a donation, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old to submit a scholarship application, make a donation, or otherwise transact on the Site. Scholarship applications concerning a child must be submitted by the child's parent or legal guardian. By using the Site you represent that the information you provide is accurate and that you have the authority to provide it, including any information about a child.

Non-discrimination. The Sylas Project, Inc. complies with all applicable federal and state laws and does not unlawfully discriminate on the basis of race, color, national origin, gender, age, religion, or disability. We provide reasonable accommodations to qualified applicants and students upon appropriate documentation of the need.
Eligibility and review. Scholarship eligibility is based on household income relative to household size, the reason financial assistance is needed, and the requirements listed on our scholarship page. Applications are reviewed confidentially by authorized Sylas Project staff only, as described in our Privacy Policy. If awarded, you arrange lessons directly with a swim instructor; we do not share your application with instructors.
No guarantee of award. Submitting an application does not create a contract and does not guarantee a scholarship. Scholarships are awarded at the sole discretion of The Sylas Project, subject to available funding, and may be limited, conditioned, or discontinued at any time.
Accuracy and verification. You agree that all information you submit is true and complete. We may verify the information you provide, and we may request additional documentation. Providing false, misleading, or incomplete information may result in disqualification and withdrawal of any award, and you may be responsible for the value of lessons obtained through misrepresentation.
Online donations are processed by third-party payment services such as PayPal, Venmo, or Stripe, and are subject to those services' own terms; you may also donate by check. The Sylas Project, Inc. is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code (EIN 85-2194333). Donations may be tax-deductible to the extent allowed by law; we do not provide tax advice, and you should consult your own advisor. We will provide a written acknowledgment for donations as required by the IRS. Donations are generally non-refundable; if you believe a donation was made in error, contact us promptly at andrea@thesylasproject.org and we will work with you in good faith. Donations support our mission of preventing accidental drowning in children.
Registration status: The Sylas Project, Inc. is a registered 501(c)(3) organization with the IRS. State charitable-registration disclosures will be added here as applicable.
The water-safety information, checklists, resources, and educational materials on this Site are provided for general informational and educational purposes only. They are not a guarantee of safety and are not a substitute for constant, active adult supervision of children in and around water, for qualified professional swim instruction, or for professional medical advice. Drowning can occur quickly and silently, and it can happen even when precautions are followed. You are solely responsible for the safety and supervision of children in your care. The Sylas Project does not provide swim instruction directly and is not responsible for the acts, omissions, qualifications, or services of any independent swim instructor. To the fullest extent permitted by law, The Sylas Project is not liable for any injury, loss, or damage arising from reliance on any content on this Site or from participation in any swim lessons funded through our scholarship program.
You agree not to use the Site to break any law, to submit false or fraudulent information, to upload malicious code, to interfere with the Site's operation or security, to attempt to gain unauthorized access to any system or data, or to infringe the rights of others. We may suspend or terminate access to anyone who violates these Terms.
The Site may link to or rely on third-party websites and services (for example, PayPal, Venmo, Stripe, and social-media platforms). We do not control those services and are not responsible for their content, terms, or privacy practices. Your use of them is at your own risk and subject to their terms.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SYLAS PROJECT, INC., ITS DIRECTORS, OFFICERS, VOLUNTEERS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE SCHOLARSHIP PROGRAM, OR ANY SWIM LESSONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify and hold harmless The Sylas Project, Inc. and its directors, officers, volunteers, and staff from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your submission of inaccurate or fraudulent information.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version here. Your continued use of the Site after changes take effect means you accept the revised Terms.
